CNBC has asked Snap to comment on the lawsuit filed by Torrez in Santa Fe County 1st District Court.
The lawsuit alleges that Snap “repeatedly made statements to the public about the security and design of its platform that were untrue” or contradicted the company’s own internal findings.
“Snap was specifically aware of, but failed to warn children and parents about, ‘rampant’ and ‘large-scale’ sextortion on its platform – a problem so severe that it forces children to face relentless and elusive blackmail demands, or Disclosure of Intimate Images to Family and Children.
An investigation by the New Mexico Department of Justice led by Torrez in recent months found the existence of a “vast network of dark sites dedicated to sharing stolen, non-consensual pornographic images from Snap” and more than 10,000 Records related to SNAP and child sexual abuse material “just in the last year,” the department said.
The lawsuit alleges violations of New Mexico’s Unfair Trade Practices Act.
