A federal judge in California denies Elon Musk’s Try to stop Openai Transformation Entering for-profit entities, according to Tuesday’s documents.
The court said the plaintiffs “failed to meet the burden of proof of extraordinary relief they requested.” But other aspects of Musk’s lawsuit against the artificial intelligence startup (Musk) he co-founded with Sam Altman can be carried out.
Founded in 2015 as a nonprofit AI research lab, Openai has been commercializing its products in recent years, most notably its viral chatbot. The company is still supervised by nonprofit parents and has faced significant obstacles in restructuring to for-profit goals, largely due to Musk, who has become one of Altman’s main rivals.
In November, Shivon Zilis, a lawyer for his startup and former OpenAI board member, proposed a preliminary ban on the company’s for-profit pursuits. The request marks an escalation of legal disputes between the two countries, a case in which Musk sued Openai in March 2024 for breach of contract and fiduciary obligations.
The case was eventually withdrawn from the state court and applied in federal court, Musk expanded the complaint to include statements, including statements Microsoft Openai violated antitrust laws when Chatgpt Maker allegedly asked investors to agree not to invest in rival companies, including XAI.
In posts on X Have described it The effort to convert Openai into a for-profit company is a “complete scam” and claims that “Openai is evil”. Last December, Openai took a photo, claiming that in 2017 Musk “not only wanted, but actually created a for-profit” as a new structure proposed by the company.
Openai also said In December As it moves toward a new for-profit structure in 2025, the company will create a public welfare company to oversee business operations, remove some of its nonprofit restrictions and allow it to be more like a high-growth startup.
“The major companies are investing hundreds of billions of dollars in AI development, which shows the actual needs of Openai to continue its mission,” the Openai board wrote in a post at the time.
Last month, a group of investors led by Musk proposed to buy control of OpenAI for $97.4 billion. The proposal is aimed at nonprofits that monitor the company.
“It’s time for Openai to return to open source, security-centric forces,” Musk’s attorney Marc Toberoff said in a statement following the bid.
Ultraman rejected the proposal. Tell CNBC This is just Musk’s efforts to “slow down his competitors.”
Musk explain A few days later, in court filings, he will withdraw his efforts if Openai stops converting to a for-profit entity.
