Musk Tesla has refiled its lawsuit in federal court against Sam Altman, accusing the Tesla boss of being manipulated into co-founding OpenAI, according to a court filing released on Monday.
At the heart of Musk’s claim is his view that he was “wooed and deceived” by Altman and current OpenAI president Greg Brockman, who co-founded the artificial intelligence company on the grounds that it was A non-profit organization.
After Musk joined and invested millions of dollars, the lawsuit alleges he was “betrayed” by Altman and his associates because they and Microsoft”, “established an opaque network of for-profit OpenAI affiliates that engaged in rampant self-dealing.
“The breach of trust and deceit was of Shakespearean proportions,” the lawsuit states.

Musk has been outspoken over the past few years about his fears about artificial intelligence and the dangers it poses to humanity. Musk said in the latest lawsuit filed in Northern California District Court that he was co-founded by Altman and Brockman, who allegedly promised “it would chart a course that was safer and more open than profit-driven.”
“Altman assured Musk that the non-profit structure guaranteed neutrality and focused on safety and openness to benefit humanity, not shareholder value. But it turned out that this was all empty philanthropy – Altman perpetuated a scam hook,” the lawsuit states.
CNBC has reached out to Tesla, OpenAI and Microsoft for comment.
The lawsuit also claims Microsoft was involved in the incident.
The lawsuit identifies OpenAI as a non-profit organization without shareholders and states that Microsoft “seeks to gain influence in other ways, such as by inducing OpenAI, Inc. to use and inevitably rely on Microsoft’s cloud computing systems.”
“While Musk has expressed affection for Microsoft CEO Satya Nadella… the values of the company and OpenAI, Inc. are not consistent,” the lawsuit states.

“In the years that followed, and to this day, Microsoft has methodically further solidified its position in the OpenAI space,” the lawsuit states.
